 Uncontested divorce is defined as a divorce proceeding in which both parties work out all issues of division of property, debt, child care, alimony, pension benefits, child custody, assets, income, etc. on their own and agree to those terms. This form of divorce requires no litigation, no formal discovery process, and no courtroom trial. Process of Uncontested Divorce

When a couple opts for an uncontested divorce, only one of the pair needs to contact a lawyer. The lawyer files a divorce petition, including a waiver of citation (as the other partner does not need to be formally “cited” and notified of the divorce proceedings). After 60 days, a divorce decree is issued. Both parties present this decree before a judge, answer some basic questions affirming the terms of the agreement and the impossibility of reconciliation, and sign the decree. The couple is now divorced.
