If you and your spouse agree about how you are going to divide your property and the custody arrangement of your children, we refer to these types of cases as UNCONTESTED DIVORCES. In this situation, we have two different solutions based upon your comfort level:

Ending a marriage is never an easy and often is a very difficult decision to make,  However, if you are going to end your marriage the uncontested divorce is the most cost effective and less painful way.

What is a no-contest divorce?

a no-contest divorce is a divorce where each party agrees on how the community assets will be divided and what the custody arrangements will be for the children.

What is a contested divorce?

A contested divorce means that you and your spouse cannot agree on how to divide your community property or custody arrangements for your children.  These matters generally require an attorney representing both parties

How long will a divorce take?

The minimum time that a divorce can take in Texas is 60 days (unless there is family violence),  However contested divorces usually take much longer.

If, however, you and your spouse do not agree, you will have to deal with a contested divorce. In this situation, the process is:

Paternity/Suit Affecting Parent-Child Relationship

A suit affecting parent-child relationship (SAPCR) is a legal action in which all the issues affecting a parent and child can be adjudicated in a single lawsuit and in the case of divorce, joined with the divorce proceedings. The issues common in an SAPCR are:

  • Custody
  • Visitation
  • Child support
  • Modification of child support
  • Adoption
  • Termination of the parent-child relationship

 
Even if you are not married and you are seeking support for your child, you need to file an SAPCR. The SAPCR applies to all divorce cases involving children.

Name Change

It has been years since your divorce and your children no longer require that you bear the same last name as theirs. You decide to take back your maiden name. But when you investigate the process, it seems long and laborious. Or, perhaps you have always disliked your first or last name and want to legally change it.
